GRAND RAPIDS (WOOD-AM) - A state appeals court has thrown out a criminal case against a Kent County elections worker who was accused of stealing voter information two years ago.

James Holkeboer used a personal storage device to download voter information after plugging it into an electronic poll book in Gaines Township.

Prosecutor Chris Becker says he expects to appeal.

Clerk Lisa Posthumus Lyons said she was "deeply troubled" by the ruling.
